You must observe the currently applicable notice periods to ensure you can cancel your mobile phone contract without any problems. The notice periods vary depending on your contract.
With the amendment to the Telecommunications Act (TKG) of December 1, 2021, the following applies:
- Fixed-term contracts: If you have a fixed-term contract, you are bound to your tariff for the minimum contract term (usually 24 months). If you concluded the contract after December 1, 2021, you must give a one-month’s notice before the end of the contract. Otherwise, a notice period of three months applies.
- No minimum contract term: The notice period is generally one month for contracts without a fixed or minimum term.
- Prepaid plans: You usually don’t have to cancel your mobile phone contract. If you don’t top up your credit for a certain period, the provider will automatically deactivate the plan.
- Missed the cancellation period: In this case, your contract will renew automatically. However, according to the new law, you no longer have to wait a year. You can cancel your cell phone contract anytime with one month’s notice.

Transfer your phone number from old provider to the new one
If you change your mobile phone provider, your old provider must allow the possibility of taking your phone number to the new provider. However, your new provider must agree to this contractually.
Transferring your phone number to the new provider is free. Moreover, youu can port your number from an existing contract at any time.
If you cancel your mobile phone contract, you can transfer the number no earlier than 123 calendar days before and no later than 90 calendar days after the end of the contract.
NOTE: If you switch within the same provider, you have no right to keep your old phone number.

Termination after an extraordinary contribution adjustment §205 paragraph 4
If the insurer increases the premium or reduces the insurance benefits, you (the policyholder) have a special right to terminate the contract. You can cancel your contract within two months after being informed about the change. The cancellation will take effect when the higher premium or reduced coverage starts.
For example, suppose the insurer informs you about the increase in insurance premiums in April. In this case, you have two months (i.e., until 30 June) after receiving the letter to terminate your contract.
Right to cancel the contract (Widerrufsrecht)
The Widerrufsrecht is the legal right to withdraw from an insurance contract within a specific time frame without giving a reason. You generally have 14 days from the day you receive:
- The insurance policy,
- The contract terms and conditions, and
- A written notice of your right to withdraw (Widerrufsbelehrung).
For life insurance and private pension insurance, the withdrawal period is extended to 30 days.
You can exercise your right to withdraw in writing. We recommend sending a letter to the insurer via registered post. Registered post acts as legal proof of timely termination.
Once you cancel the contract by exercising the “Widerrufsrecht,” it is considered void. The insurer must refund any premiums you paid.
NOTE: You don’t have the right to withdraw if the insurer entirely performed the contract before you exercised the Widerrufsrecht.
